Contract
The Signatory recognises a responsibility to confirm the DATE and DETAILS of the project as indicated on the invoice and that the signing of this contract is to form confirmation of such details.
INCLUSIONS:
The Photographer agrees to deliver the following items as part of a package to the Signatory:
DELIVERY:
The Photographer agrees to deliver all final products within two (2) months of the Project Day as specified.This clause will not apply if this Contract is breached in any way by the Signatory.
The Signatory recognises that no final product or preview products shall be delivered until full payment is made.
The Signatory recognises that they are purchasing a service and final product from the Photographer and understand that .ARW, RAW, .CR3 and individual .MP4, .MOV or .XAVC clips are the property of the Photographer and are not subject to distribution or purchase unless with the express written permission of the Photographer.
RETAINER, PAYMENT, CANCELLATION and CORONAVIRUS (COVID-19):
The Signatory recognises that there shall be a NON-REFUNDABLE retainer to the sum of 30% of the final cost.
Both BLS and the signatory recognise payment of retainer as a signature to this contract.
The Signatory recognises that the retainer made will act as a reservation for the Signatory’s Project Day and, upon receiving the retainer, the Photographer recognises that no other bookings or appointments shall be made on the Project Day.
In the event the signatory cancels their reserved booking within three (3) months of the designated project date the retainer will be forfeit and a cancellation fee of seven-hundred dollars ($700) shall be applicable.
The Signatory recognises that the full outstanding payment must be paid at least fourteen (14) days before the Project Day.
The Signatory recognises that payments made after the allocated date of the project booking will incur a 10% late fee devised from the total of the package cost.
In the event of a last minute booking (within thirty days of the proposed project date) the full payment shall be paid upfront, forgoing a retainer.
The fifty-percent (30%) retainer made by the Signatory is by no means available for refund or negotiation.
The signatory recognises the total fees, including any discounts or special offers and has agreed to compensate Brad L. Spencer the enclosed amount.
ARRIVALS AND DEPARTURES:
The Photographer recognises a duty to be in attendance of the wedding and preparation sites at the delegated times.
The Photographer may be asked to stay for up to an additional three (3) hours on the Project Day at an additional cost, though not all three hours must be redeemed. Hours will be capped at 10.5 hours per project.
Additional hours rendered and paid for will total to a minimum of one (1) hour.
The additional cost of additional shooting hours will be to the amount of $716 per person representing and accompanying the Photographer per hour.
In the event the Photographer and/or other accompanists are concerned for their safety they reserve the right to dismiss themselves from the project date before the designated time either individually or simultaneously.
In the event the Photographer and/or other accompanists are injured physically they reserve the right to dismiss themselves from the project date before the designated time either individually or simultaneously.
In the event the Photographer and/or other accompanists are abused physically or verbally by the venue hosts, wedding attendee’s or the bridal party they reserve the right to dismiss themselves from the project date before the designated time either individually or simultaneously.
In the event the Photographer and/or other accompanists believe that a Responsible Service of Alcohol (or RSA) License is being abused or ignored they reserve the right to dismiss themselves from the project date before the designated time either individually or simultaneously.
PERSONAL APPEARANCE AND ITEMS:
The Signatory recognises their own duty to maintain their desired appearance throughout the day and that the Photographer has no obligation to the specific style or appearance of wedding attendees or bridal party personal appearances or stylings.
EXCLUSIVITY:
The signatory recognises that Brad L. Spencer and any other affiliates of the Photographer present on the Wedding Day are to be the only official photographers/cinematographers and any and all other photographers are discouraged.
Brad L. Spencer reserves the right to refuse to provide services to anyone and any event whatsoever in his sole discretion. Any such refusal will be provided after an initial conference, and if done so after any retainer is made, that retainer will be refunded.
EQUIPMENT:
The Photographer shall maintain the quality and standard of their product using the appropriate equipment on the project date.
The Photographer and accompanying photographers/cinematographers will at all times carry the appropriate backup equipment to ensure coverage.
In the event of equipment damage or technical fault, the Photographer will seek the appropriate solutions (i.e. emergency rental) at no expense to the signatory. In the event these solutions are not available the Photographer reserves the right to dismiss themselves from the project date before the designated time and compensation arrangements shall be made accordingly.
INSURANCES and CHECKS:
Brad L. Spencer and associates will at all times uphold a PUBLIC LIABILITY INSURANCE subscription.
OTHER STIPULATIONS:
The Signatory recognises a responsibility to provide meals to all members representing Brad L. Spencer, including all photographers and cinematographers, at an appropriate time.
Attached is a representation of the agreed upon total cost of fees and/or commissions between the signatory and Brad L. Spencer in the form of an invoice.
